Biography

Kathleen A. Burr joined Lipsitz, Ponterio & Comerford, LLC in 2002. She represents children injured by lead paint poisoning. Throughout her legal career, Ms. Burr has been involved in lead paint litigation, and she brings her experience to serve the children and families she now represents.   Over the years, Ms. Burr has been involved in a number of appellate court cases that helped to form the legal standards that govern lead poisoning litigation in New York State, and is is an accomplished appellate practitioner.

Ms. Burr also has a strong background in insurance coverage issues. At Lipsitz, Ponterio & Comerford, LLC, Ms. Burr represents policy holders in first party property loss cases; and handles coverage issues that can arise in lead poisoning litigation.

The policyholder cases handled by Ms. Burr involve property and business income losses caused by fire, and weather-related conditions. Her work on behalf of two Rochester business owners in a fire loss case resulted in a significant recent decision by the New York Court of Appeals in the arena of first-party insurance disputes. The case, Bi-Economy Market Inc. v. Harleysville Insurance Co. of New York, et al., 10 NY 3d 187 (2008), gives policyholders a much-needed remedy to claim consequential damages as a result of improper or wrongful claims handling by insurers.

Ms. Burr’s earlier work on behalf of a Niagara Falls business owner in an insurance coverage dispute over a water loss resulted in a large settlement against an insurer.
