The law firm of Lipsitz & Ponterio, LLC is announcing a total of $2.58 million in settlements on behalf of a Schenectady, NY man against several distributors and manufacturers of joint compound, paint, and floor and ceiling tiles. The plaintiff was previously employed as licensed contractor who applied paint and installed drywall, flooring and ceiling tiles for Rite Aid stores throughout New York State. Beginning in 1964, our client was exposed to asbestos fibers, dust and particles when he was exposed to joint compound and ceiling tiles when he was employed as a lather.
From 1971-1979, the plaintiff was employed as a licensed contractor and would participate in converting approximately ten Rite Aid stores per year, which on average lasted one to one and one-half months per store. During the construction of these stores, the plaintiff was exposed to joint compound, paint, ceiling and floor tiles which contained asbestos. On a daily basis he applied and sanded products that contained asbestos.
As a result of exposure to asbestos-containing products, the plaintiff was diagnosed with malignant mesothelioma in 2007 at the age of 61.
