The law firm of Lipsitz & Ponterio, LLC, is announcing a total of $1.8 million in settlements on behalf of a former mold shop stock handler against several manufacturers and distributors of asbestos-containing plastic molding compound. In approximately 1966 and for about six months, our client was employed as a stock handler in the finishing department at Diemolding Corporation in Canastota, New York.

During the course of his brief employment, the plaintiff was exposed to asbestos-containing plastic molding compound when he operated the tumbling machine at Diemolding. After the plastic parts were molded, the plaintiff loaded the tumbling machine with the parts in order to remove excess plastic. After the tumbling cycle finished, he cleaned the machine by using an air hose to remove excess debris and dust left behind from the tumbling process. He also swept up the plastic dust from the floor surrounding the machine. The plaintiff’s exposure to asbestos occurred when he air-hosed the tumbling machine and when he swept-up the dust left behind from this process.

In 2009, and as a result of his exposure to asbestos-containing plastic molding compound, the plaintiff was diagnosed with malignant mesothelioma at the age of 78.
